A displaced person who fled the full-scale war from the city of Toretsk in the Donetsk region to Dnipro has filed a lawsuit against the Ministry of Defense, demanding half a million hryvnias for the military's occupation of her home. She claimed that they damaged her property and used her belongings. This was reported by "Vidomo" citing "Dnipro Operational".
In March 2024, the displaced individual from Toretsk submitted a lawsuit to the Ministry of Defense of Ukraine. She sought 500,000 hryvnias in compensation for moral damages, alleging that the military had unlawfully occupied her house in December 2022.
According to data from the judicial registry, it was stated that the Ukrainian defenders lived in the displaced person's home based on a verbal agreement with her and had committed to paying for utility services. Neighbors confirmed that there were indeed strangers in the house, but could not definitively identify them as Ukrainian Armed Forces personnel.
Furthermore, the police did not verify any reports of robbery or significant damage to the woman’s home.
The Samarsky District Court reviewed the case and ruled against the displaced person, as she did not provide sufficient evidence that the military had caused her harm.
Judge Alla Plinska noted that the plaintiff had access to the house, could retrieve her belongings, and no one prevented her from using her property. Additionally, Judge Plinska explained that in wartime, both military personnel and civilians must fulfill their constitutional duties.
On January 28, 2025, Judge Alla Plinska denied the woman compensation. The displaced person has 30 days from the date of the ruling to appeal.
