As of the end of 2024, according to the court registry, 3,630 lawsuits and court orders against co-owners in debt have been filed by the homeowners' association (HСA) in court. The number of claims due to debts has doubled compared to the same period before the full-scale war began. The highest number of lawsuits for debts related to HСA is in the Dnipropetrovsk region. This is reported by Opendatabot, as conveyed by "Vidomo".
Last year, 3,600 cases against debtors of HСA were submitted to the courts in Ukraine. This is 2.7 times more than at the beginning of the war when 1,340 cases were filed in a year.
The most frequent lawsuits for HСA debts were filed in the following regions:
Requests for court orders have become particularly popular – such cases are now considered without the parties being summoned to court. With the order in hand, HСA approach the offenders and collect payments from the debtors.
The number of court orders has increased – in 2024, 2,200 orders were issued, nearly the same as before the full-scale war began. However, recovery is not always possible:
"The recovery system works when the debtor has some property that can be seized — for example, a car. If there is no such property, the seizure of an apartment can be quickly lifted by stating that it is the only place of residence, or by registering minor children there.
Thus, the only effective measure against chronic debtors remains finding vulnerabilities in their activities, such as illegal use of the common property of the building, etc. In our experience, there are many cases where systematic work with debtors leads them to make payments independently.
For those who find this challenging, there is a written warning that details how the HСA cannot carry out certain repair works on sewage, ceilings, elevators, ventilation ducts, and so on due to such a debtor," said Stanislav Draganov, president of the Association for Innovative Development of Households.
